Alabama Supreme Court grants request for oral arguments in former Decatur officer Mac Marquette’s appeal

MONTGOMERY, Ala. (WHNT) — The state supreme court has granted a request by former Decatur Police Officer Mac Marquette to have oral arguments heard in his third attempt to have his charges thrown out.
Marquette is arguing he acted in self-defense the night he killed Stephen Perkins during a botched repossesion of Perkins’s truck.
Two lower courts, the Morgan County Circuit Court and the Alabama Court of Criminal Appeals, have already rejected the self-defense claim. Those courts have said a jury should decide if Marquette’s killing of Perkins was justified.

Alabama Supreme Court records show that oral arguments in this appeal are set for January 28, 2026, at 10:00 a.m. The arguments will take place at the University of Alabama.
His murder trial in Morgan County is set for January 26, 2026, but that will more than likely be moved back due to his appeal.
